No. 1 Mining Enterprise (ME 1) is a State-owned enterprise (SOE) operating under the Ministry of Natural Resources and Environmental Conservation (MONREC) that also acts as the regulator for the sector of non-ferrous metal production and marketing. As such, the SOE is endowed with the responsibility to grant permits and collect part of the tax on profits made by private companies that are either in ‘production-sharing contracts’ or in joint venture with ME 1. On 1 Feb 2021 the Myanmar Armed Forces (Tatmadaw), led by Commander-in-Chief Min Aung Hlaing, seized power from the legitimate civilian Government in a coup d’état and established the State Administration Council (SAC) to exercise legislative, executive and judicial powers of the State. On 2 Feb 2021 the military regime appointed a new cabinet, including a new minister for Natural Resources and Environmental Conservation (MONREC). Through the SAC and the new cabinet, the military regime acquired control over and benefits from SOEs, including No. 1 Mining Enterprise. No. 1 Mining Enterprise is thus controlled by and generates revenue for the Tatmadaw, therefore contributing to its capabilities to carry out activities undermining democracy and the rule of law. Moreover, No. 1 Mining Enterprise has taken part and/or overseen various projects linked to violence by the Tatmadaw against civilian populations and violation of their most basic rights, including through land confiscation and forced relocation. No. 1 Mining Enterprise is therefore responsible for supporting actions that threaten the peace, security and stability of Myanmar/Burma.

Mining Enterprise no 1 (ME 1) est une entreprise d’État relevant du ministère des ressources naturelles et de la conservation de l’environnement (MONREC), qui joue également le rôle de régulateur dans le secteur de la production et de la commercialisation des métaux non ferreux. À ce titre, l’entreprise d’État est chargée d’accorder des autorisations et de prélever une partie de l’impôt sur les bénéfices réalisés par les sociétés privées qui font l’objet de “contrats de partage de la production” avec ME 1 ou qui constituent une coentreprise avec elle. Le 1er février 2021, les forces armées du Myanmar (Tatmadaw), dirigées par le commandant en chef Min Aung Hlaing, ont pris le pouvoir des mains du gouvernement civil légitime dans le cadre d’un coup d’État et ont créé le Conseil d’administration de l’État (SAC) pour exercer les pouvoirs législatifs, exécutifs et judiciaires de l’État. Le 2 février 2021, le régime militaire a nommé un nouveau gouvernement, dont un nouveau ministre des ressources naturelles et de la conservation de l’environnement (MONREC). Par l’intermédiaire du SAC et du nouveau gouvernement, le régime militaire a acquis le contrôle et les avantages des entreprises d’État, dont Mining Enterprise no 1. Mining Enterprise no 1 est donc contrôlée par la Tatmadaw et génère des recettes qui lui sont destinées, ce qui contribue à sa capacité à mener des activités portant atteinte à la démocratie et à l’état de droit. De plus, Mining Enterprise no 1 a participé à divers projets en rapport avec les actes de violence perpétrés par la Tatmadaw contre la population civile et avec les violations de leurs droits les plus fondamentaux, y compris par la confiscation des terres et la relocalisation forcée, et/ou a supervisé de tels projets. Par conséquent, la Mining Enterprise no 1 soutient des actions qui menacent la paix, la sécurité et la stabilité du Myanmar/de la Birmanie.
