Since the military coup, the military regime has acquired control over and benefits from SOEs, including No 2 Mining Enterprise. No 2 Mining Enterprise is thus controlled by and generates revenue for the Myanmar armed forces (Tatmadaw), thereby contributing to its capabilities to carry out activities which undermine democracy and the rule of law.

No 2 Mining Enterprise (ME 2) is a state-owned enterprise (SOE) under the jurisdiction of the Ministry of Natural Resources and Environmental Conservation (MONREC) that also acts as the regulator for the sector of non-ferrous metals production and marketing. As such, the SOE is endowed with the power to grant permits and collect part of the tax on profits made by private companies that are either in so-called “production-sharing contracts” or in joint ventures with ME 2.

No. 2 Mining Enterprise (ME 2) est une entreprise d’État relevant du ministère des ressources naturelles et de la conservation de l’environnement (MONREC), qui joue également le rôle de régulateur dans le secteur de la production et de la commercialisation des métaux non ferreux. À ce titre, l’entreprise d’État est chargée d’accorder des autorisations et de percevoir une partie de l’impôt sur les bénéfices réalisés par les sociétés privées qui ont des “contrats de partage de la production” avec ME 2 ou qui forment une coentreprise avec celle-ci. Le ministre des ressources naturelles et de la conservation de l’environnement, U Khin Maung Yi, a été nommé par le Conseil d’administration de l’État (SAC), qui s’est emparé des pouvoirs législatif, exécutif et judiciaire de l’État à partir du 2 février 2021. Depuis le coup d’État militaire, le régime militaire a pris le contrôle des entreprises d’État, dont No. 2 Mining Enterprise, et en tire profit. No. 2 Mining Enterprise est ainsi contrôlée par les forces armées du Myanmar (Tatmadaw) et génère des recettes à leur profit, ce qui contribue à la capacité de celles-ci à mener des activités portant atteinte à la démocratie et à l’État de droit. De plus, No. 2 Mining Enterprise a participé à divers projets en rapport avec les actes de violence perpétrés par les forces armées du Myanmar/de la Birmanie contre des civils et avec la violation de leurs droits les plus fondamentaux, y compris par la confiscation de terres et la relocalisation forcée, et a supervisé ces projets.
