Owing to his leading position in Twirwaneho and his direct involvement in the forced recruitment and use of children, Charles Sematama is therefore involved in planning, directing or committing acts that constitute serious human rights violations or abuses in the DRC. He is also responsible for sustaining the armed conflict, instability and insecurity in the DRC.

Twirwaneho sustains the armed conflict, instability and insecurity in the DRC and is responsible for serious human rights abuses in that country, in particular through the voluntary or forced child recruitment to participate actively in hostilities, attacks against civilians and the Congolese armed forces (FARDC), and killings, such as attacks against civilians in Mikenge village in November 2021 which killed at least six persons.

Charles Sematama est un ancien officier des Forces armées congolaises (FARDC) et occupe une fonction dirigeante en tant que commandant et chef militaire adjoint du groupe armé non gouvernemental Twirwaneho opérant au Sud-Kivu, qui prétend représenter la communauté Banyamulenge. Le groupe armé Twirwaneho entretient le conflit armé, l’instabilité et l’insécurité en RDC et est responsable de graves violations des droits de l’homme dans ce pays, en se livrant notamment au recrutement volontaire ou forcé d’enfants en vue d’une participation active aux hostilités, à des attaques contre des civils et les Forces armées congolaises (FARDC) ainsi qu’à des assassinats, comme les attaques contre des civils dans le village de Mikenge en novembre 2021, qui ont coûté la vie à au moins six personnes. En outre, Charles Sematama a participé directement à des séances de propagande ainsi qu’au recrutement forcé et à l’utilisation d’enfants, y compris en tant qu’escortes armées. En raison de ses fonctions dirigeantes au sein du groupe armé Twirwaneho et de sa participation directe au recrutement forcé et à l’utilisation d’enfants, Charles Sematama contribue donc, en les planifiant, dirigeant ou commettant, à des actes constituant de graves violations des droits de l’homme ou de graves atteintes à ces droits en RDC. Il est également responsable d’entretenir le conflit armé, l’instabilité et l’insécurité en RDC.
