En tant que dirigeant du M23, il participe à la promotion et au soutien des activités du groupe armé. En janvier 2023, il a été promu général de brigade de l'Armée révolutionnaire du Congo, la branche armée du M23. Il a ensuite été nommé chef d'état-major et adjoint de Sultani Makenga et a validé depuis la planification de toutes les opérations menées par le M23 en RDC. Il fait l'objet d'un mandat d'arrêt émis par les autorités congolaises. Il s'est livré et continue de se livrer à des actes qui compromettent la paix et la sécurité de la RDC. Dirigeant militaire d'une milice congolaise qui reçoit un appui venant de l'extérieur de la RDC et entrave le processus de désarmement et de réintégration, Bernard Maheshe BYAMUNGU dirige le M23, une entité désignée. Renseignements complémentaires: Bernard Maheshe BYAMUNGU a régulièrement abusé de ses pouvoirs en tant que dirigeant militaire de plusieurs groupes armés pour commettre des actes portant atteinte aux droits humains en RDC. Lorsqu'il était commandant de haut rang de la 8e brigade du Rassemblement congolais pour la démocratie à Goma, il a planifié et dirigé des atrocités à Kindu, dont l'exécution extrajudiciaire publique de trois soldats dans les rues de la ville. Il a ensuite dirigé un grand nombre d'exécutions opportunistes de civils dans le Kivu, lesquelles constituent des atteintes aux droits humains. Depuis au moins 2012, il est affilié à l'entité désignée M23, dont il est l'un des dirigeants. Depuis octobre 2022, il est commandant adjoint chargé des opérations et du renseignement au sein du M23, lequel a commis des atrocités contre des civils, notamment à Kishishe le 29 novembre 2022.
